Public offer agreement

This agreement is an official and public offer of Nataliya Serhiivna Nikolayenko, an individual entrepreneur (hereinafter referred to as the “Seller”) to conclude a contract for the purchase and sale of goods presented on the website. https://chukjewels.com , with any individual (hereinafter referred to as the "Buyer").

In accordance with Articles 633, 641 and 642 of the Civil Code of Ukraine, this document is a public offer, and in case of acceptance of the conditions set out below, the Buyer undertakes to comply with the terms of this agreement.

1. General provisions

1.1. This agreement is public and determines the procedure for buying and selling goods through the Seller's online store.
 1.2. Publication of information about goods on the website is an offer to conclude a contract.
 1.3. Acceptance of this offer is considered to be the placing of the order and its payment by the Buyer.

2. Subject of the contract

2.1. The Seller undertakes to transfer the goods presented on the website to the Buyer, and the Buyer undertakes to accept and pay for them.
2.2. The name, quantity and price of the goods selected by the Buyer are indicated in the order.

3. Ordering

3.1. The order is placed through the website https://chukjewels.com .
 3.2. To place an order, the Buyer enters the necessary data (full name, contact phone number, delivery address).
 3.3. After confirming the order, the Seller sends information about payment details.

4. Price and payment method

4.1. Prices for goods are determined on the Seller's website.
4.2. Payment is made by the Buyer in the national currency of Ukraine - hryvnia.
 4.3. Available payment methods:

  • payment by bank card online;

  • payment via bank transfer to the Seller's account.

5. Delivery and terms of transfer of goods

5.1. Delivery is carried out across the territory of Ukraine using courier services ("Nova Poshta", "Ukrposhta", etc.).
 5.2. The cost of delivery is paid by the Buyer, unless otherwise provided for by the terms of promotions or special offers.
 5.3. The risks of accidental loss or damage to the goods pass to the Buyer from the moment the goods are handed over to the courier service.

6. Return and exchange of goods

6.1. Return and exchange of goods is carried out in accordance with the Law of Ukraine "On Protection of Consumer Rights".
6.2. Goods of proper quality are subject to return, if they have not been used, their presentation, consumer properties and packaging have been preserved.
 6.3. Refunds are made within 14 calendar days from the date of receipt of the returned goods by the Seller.

7. Rights and obligations of the parties

The seller is obliged to:

  • ensure the availability of the ordered goods;

  • to transfer the goods within the time agreed with the Buyer;

  • provide reliable information about the product.

The buyer is obliged to:

  • pay for the order on time;

  • check the completeness and appearance of the goods upon receipt.

8. Responsibility of the parties

8.1. The Parties are liable for failure to fulfill or improper fulfillment of obligations in accordance with the current legislation of Ukraine.
 8.2. The Seller is not responsible for the actions of courier services and for damage caused by improper use of the goods by the Buyer.

9. Confidentiality and protection of personal data

9.1. By placing an order, the Buyer consents to the processing of his personal data in accordance with the Law of Ukraine "On Personal Data Protection".
 9.2. The Seller guarantees the use of personal data solely for the purpose of fulfilling the terms of this agreement.

10. Contract validity period

10.1. The Agreement shall enter into force from the moment of acceptance of the offer by the Buyer and shall remain in effect until the parties fully fulfill their obligations.
 10.2. The Seller reserves the right to make changes to this agreement with mandatory publication on the website.
